[Granville County, N.C.?], 28 March 1782. 1 full page, small folio, neatly inlaid, verso docketed. A RARE NORTH CAROLINA SIGNER WITNESSES A LEGAL SETTLEMENT Penn studied law under Virginia's Edmund Pendleton (a relative), and served several terms in the Continental Congress from 1775-1780 before retiring to pursue his legal practice. The present Memorandum of Agreement, probably marks the adjudication of a legal contest between two local farmers, James Early and John Schrogau. The latter, it is agreed, "shall pay all costs of proceedings upon a warrant of unlawful entry lately decided in his favor." He "shall be permitted to retain the possession of the land during the present year" for a rent of £20. Early, it is agreed, shall sow "wheat and other small grain in proper time in the Fall...not doing any damage to the crop of Schrogau." Finally, "on or before 25 December" Schrogau is to relinquish the land to Early. "Witness our hands and seals..." At the bottom are signatures of the two litigants and, at the left, those of two witnesses, J.C. Gibson and John Penn the Signer. Penn, who also signed the Articles of Confederation, is a relatively rare Signer, due to his untimely demise at age 48.
